Consumer warranty general conditions
Valcucine product guarantees are issued by Valcucine S.p.A., with registered office in Via L. Savio no. 11, 33170 Pordenone, Italy, registered in the Pordenone Register of Companies registration number and VAT Number 00407160936 (hereafter “Valcucine”), without prejudice to the legal obligations of the Retailer.
1) Duration
1.1 The duration of the warranty is 10 (ten) years from the date of purchase/delivery of products to the first purchaser, which must be confirmed with presentation of invoice or receipt.
1.2 In order to benefit from this warranty the consumer must retain and present the Customer Purchase Document which is delivered with the products and contains the product purchase identification information.
1.3 In the case of products purchased from the Retailer Showroom display or, however, purchased previously from the Retailer (products in stock) the ten-year warranty period is effective from delivery of products by Valcucine to the Retailer.
1.4 If the warranty claim is requested more than 2 years after the product purchase/delivery date, which must be confirmed by presenting the invoice or receipt, the Retailer may charge the consumer for labour costs relating to repair/replacement of the faulty item as well as transport costs from the Retailer's warehouse to the consumer's home.
2) Use of products
Given the structural characteristics of the products, the warranty only applies to products used for domestic ends and purposes and therefore excludes products used for professional and/or industrial purposes.
3) Exclusions
3.1 Electrical appliances, sinks, mixer taps, lighting systems and any other accessory not manufactured by Valcucine are excluded from the warranty.
Complaints regarding faults with or damage caused by such appliances or devices must therefore be addressed to their manufacturer directly, according to the warranty conditions applicable to the said appliances or devices.
3.2 The following events are furthermore excluded from the warranty:
- normal component wear and tear
- damage caused by failure to observe prescribed maintenance and cleaning procedures or failure to observe rules prescribed in the user manual
- damage caused by improper use of product
- knocks
- difference between sample colour displayed at time of purchase and delivered product colour
- colour variation over time (for example in wood or lacquered surfaces, etc.)
- variation in size owing to a change in the environmental humidity balance
- damage following incorrect assembly
- damage caused by installation of non-original accessories or spare parts
- damage caused by repairs carried out by unauthorized personnel
- tampered with products
- damage caused by inadequate electrical and power supply systems.
3.3. the warranty covers replacement of glass parts in the event of complete breakage (shattering).
Scratching or chipping of glass parts are therefore not covered under warranty. Tempered glass is used, but any knocks from similar or harder materials (e.g. ceramic) may cause scratching or chipping.
Furthermore, events mentioned in paragraph 3.2 that cause glass to shatter are not covered under warranty, particularly including knocks, collisions and improper use of glass parts (for example, overloading).
4) Territorial limits
This warranty is valid in all countries around the world.
5) Warranty claims
Warranty claims must only be submitted in writing and addressed to the Retailer where the products were purchased clearly stating the reason for the claim and attaching, where possible, photographic evidence to support the claim.
If the Retailer where the products were purchased is no longer an authorized Valcucine Retailer, the consumer may address the claim to another authorized Valcucine Retailer near his or her home.

The consumer must notify Valcucine of the product defect or damage within twenty days of discovery. The claim must be supported with a photocopy of the purchase invoice or VAT receipt and photographs where possible.
6) Intervention arrangements under warranty
6.1 In no circumstances may unauthorized Retailers perform interventions under warranty.
The consumer may choose to either request repair or replacement of the product at no charge in both cases.
If the chosen course of action is objectively not possible or if Valcucine deems it too costly compared to the alternative one, Valcucine will first assess the opportunity for repairing the goods, if possible, wherever the cost of repairs does not exceed product value and purchase price.
If the cost of repairs is excessive, Valcucine will replace the product, in which case Valcucine and/or the Retailer will be entitled to collect the replaced product and regain ownership of it.
Valcucine will be entitled to replace the faulty product with a more recent model of equal quality and performance, where compatible.
Repairs or replacements will be made within a reasonable interval after receiving the request (with documentation), at the discretion of Valcucine.
6.2 For interventions under warranty outside of Italy, but in countries within the European Union, Valcucine will only pay transport costs of replacement materials to the warehouse of the Authorized Retailer where the consumer purchased the product, with any further transport costs charged to the consumer.
For interventions under warranty in countries outside of the European Union, Valcucine will make material available for pick-up at their factory, with transport fees charged to the consumer and/or Retailer where the product was purchased.
7) Data protection clause
7.1 Pursuant to Italian Legislative Decree no. 196/2003 “Data Protection Code", subsequently integrated and modified (hereafter referred to as the “Privacy Law”), processing of personal data of the consumer collected by Valcucine, the data holder, is carried out, both by electronic and automated means, and also manually, with the application of adequate safety measures for protection and safeguarding of data and exclusively for execution of contractual or legal obligations, with the purpose of allowing the consumer to benefit from this warranty and favour the intervention of the authorized service centre.
For these purposes provision of data is necessary and failure to provide the required data at the beginning of or during the course of the contractual relationship may prevent Valcucine from activating the services made available to the consumer under warranty.
7.2 Data collected by Valcucine and/or supplied by the consumer, collected and used by Valcucine also using computer systems in respect of the Privacy Law regulations, may be added into an electronic or other data bank owned by Valcucine, for purposes directly connected to and instrumental to Valcucine business and the provision and management of services covered by this warranty.
7.3 The consumer's personal data may be communicated or disclosed to the following categories of entities: entities whose access to the data is granted by legal provisions or regulations; banks or building societies for handling of receipts and payments, financial, insurance and auditing organisations; debt recovery companies; legal, administrative and tax advisory services; data processing and IT service companies; mail delivery companies; subsidiary, affiliated or parent companies.
The data will never be disseminated, unless with the consumer's explicit consent.
7.4 In relation to the processing of personal data, pursuant to Art. 7 of the Privacy Law, the consumer has the right, among other things, to obtain from Valcucine: a) confirmation of the existence of his or her personal data and the communication, in intelligible form, of such data and their source and method of processing; b) erasure, anonymization or blocking of data that have processed unlawfully; c) updating, rectification or, where interested therein, integration of the data.
The consumer furthermore reserves the right to oppose processing of personal data regarding him or her for legitimate reasons.
8) Governing law and dispute resolution
8.1 This warranty and any disputes of both contractual and non-contractual nature connected to the products and/or damage deriving from the products shall be governed by the Italian law.
8.2 All disputes arising from the interpretation and/or application of this warranty and/or complaints regarding defects in product quality and/or damage caused by the product shall be placed under the sole jurisdiction of the Court of Pordenone (Italy).
9) Statutory rights
Independently of the terms of this warranty the consumer will be entitled to the rights and faculties set out by the applicable laws governing the sale of consumer goods, which are in no way prejudiced by these general conditions.
